PRIVACY POLICY – PROCESSING OF PERSONAL DATA

WHO IS RESPONSIBLE FOR PROCESSING YOUR DATA?

Your data are solely processed by our Company in accordance with Article 7A paragraph 1 (b) of Law 2472/1997, in order to fulfill your order, and in no way will they be shared, disclosed or sold to third parties, unless the procedure laid down in the law for the removal of confidentiality is initiated (Law 2225/1994), or any obligations arise from the national implementation of the Directive 24/2006 or the Law.

WHAT KIND OF PERSONAL DATA DO WE PROCESS?

- BOHBO may collect the following personal data from the users of its website through the various contact forms thereon: name, e-mail address, postal address, telephone number, date of birth, sex and credit card details or account number (provided by the customer in case of a merchandise return). Such contact forms may used when the user visits the online store, creates an account at the online store, subscribes to our newsletters, places an order, or participates in BOHBO’s special offers or other promotional activities.

- In addition, BOHBO collects information about its users’ navigation at the online store in order to provide better personalized service to its users and to continually improve its online presence. More specifically, when you visit our online store, the following items will be stored for technical reasons in so-called 'log files':

  •          the IP address of the computer you use to access our website
  •          cookie data
  •          the web page from which you visit us
  •          the pages within our site you visit
  •          the date and duration of the visit
  •          the type of browser the visitor uses
  •          the operating system of your computer
  •          location data

(Apart from being aggregated and stored on our online shop’s management platform, most of the above data is also aggregated and recorded by the GoogleAnalytics data management platform, which is linked to our online store as an add-on [plug-in] and enables our company to better manage and utilize the data collected in order to provide improved services to our visitors. On behalf of BOHBO it is confirmed that the data collected through this platform are only accessible by our company, and only our company or its affiliates have the right to manage and exploit this data. Finally, it is noted that plug-ins are subject to the privacy policy of the respective platform and not to our Policy.)

All personal data is provided by the person concerned, with the exception of contact details which may be given by friends or relatives, following permission they have obtained from the third party concerned, in the following cases:
 
a) To send a gift. In particular, the name, address and telephone number of the designated recipient are recorded.
b)To share their favorite products (Wish list), which are stored in our online store and can be managed through their account. In particular, the e-mail address to which a user sends their wish list is recorded.

WHAT IS THE PURPOSE OF OUR PROCESSING OF PERSONAL DATA?

Personal data will be processed for the following purposes:

- Management and processing of the subscription to the online store. Subscription refers to a user’s browsing profile of the BOHBO online store. This profile contains the subscriber’s personal information and navigation information as well as the products displayed or added to the cart, the categories of the e-shop they visited, their location to evaluate their preferences and / or personal interests with the purpose of providing to the individual customer the content, such as offers, services and products that best fit their profile.

- Management and processing of online purchases. We use the customer's personal information to process and deliver their order and to notify them by email about the status of their order or any modifications to their order.

- Management and individual distribution of information about exclusive offers, latest news and personalized information tailored to the profile, interests and needs of the customer via e-mail. Sending this information means processing the user’s profile which includes the use of personal data, purchase history, and navigation information in the online store to evaluate personal preferences in order to offer them the commercial communications that fit their profile.

FOR HOW LONG DO WE STORE PERSONAL DATA?

BOHBO will only store your personal data for as long as it is reasonably necessary to take into account the need to provide answers to issues raised or to resolve problems, to make improvements, to activate your services, and to meet the conditions required by current legislation. This means that BOHBO may store a user’s personal data for a reasonable time even after the person has stopped using the BOHBO services or has stopped using the online store. At the end of this period, personal data will be deleted from all BOHBO systems.

WITH WHO DO WE SHARE PERSONAL DATA?

The personal data of the person concerned may be conveyed to the following recipients:

-Public Authorities and Organizations when required by the financial and labor regulations, the social security regulations or other applicable regulations/legislation.

- User information, in particular the name and messages / comments submitted by the user ("User Submissions"), may be displayed, on the basis of a license granted by BOHBO, on prominent locations in the online store, if the user chooses to submit such information in the relevant fields. In particular, we refer to the feedback / testimonial form which is used on our online store and which is accessible to all users of the e-shop. We reiterate that any content (including but not limited to, photographs, captions, and comments) that you voluntarily disclose to be visible to other users in the particular public forum of the online store is not personal data; it becomes publicly available, it can be collected and used by others and relayed over the Internet and other communication channels.

- Data management companies which have taken on advertising and promotional services for BOHBO and use on BOHBO’s behalf information provided by plug-ins placed in our online store in order to create personalized ads based on user preferences and / or user location.

More specifically:

We may incorporate into our online store a social media application programming interface or plug-ins of social media, including Facebook and others. Plug-ins can transfer information about you to the corresponding Plug-in platform without any action taken by you. This information may include the user ID of the platform (IP), the site you have accessed, and others. Interaction with a plug-in will transfer information directly to the social network of that Plug-in, and this information may be visible to others using this platform. Plug-ins are subject to the privacy policy of the platform, and not to our Policy.

BOHBO will in no case sell the customer data to third parties.

HOW DOES BOHBO PROTECT PERSONAL DATA?

The online store uses information security techniques such as access control procedures and encryption mechanisms, all of which aim to prevent unauthorized access to the information and guarantee confidentiality. In order to achieve these goals, the user accepts that BOHBO will acquire data to verify access control.

In addition, any transaction through the online store is completed through a secure payment system. Secure payment data is sent directly and encrypted (via SSL) to the responsible entity.

 WHAT ARE YOUR RIGHTS RELATED TO PERSONAL DATA?

As an e-shop user, you have the following rights to exercise through the email address info@bohbo.eu or through the contact form. The BOHBO department responsible for data management is required to respond to your request directly, as well as having the right to request confirmation of your identity before taking any action.

- Right to Personal Information:

You have the right to obtain confirmation as to whether we handle personal data of yours or not, and to access the personal data available to you for your benefit. If you have created an account at our online store, you can easily do so yourself by using the “My Personal Data” button on the MY ACCOUNT page.

- Right to Correction of Personal Data:

You have the right to ask BOHBO to correct your personal data in case it is inaccurate or to fill in in case it is incomplete. If you have created an account with our online store, you can edit your data yourself by using the “My Personal Information” button on the MY ACCOUNT page.

- Right to Delete Personal Data:

You may ask us to delete your personal data when, among other reasons, the data is no longer necessary for the purposes for which it was collected. Contact us by sending an e-mail to info@bohbo.eu or by using the contact form.

- Right to be removed from the Newsletters:

You have the right to unsubscribe from our newsletters at any time by clicking here.

GOOGLE FONTS AND PERSONAL DATA

This site uses Google fonts (https://www.google.com/webfonts). PERSONAL DATA OF MINORS

We do not intend and do not wish to collect any personal information concerning children under the age of 13. Any use of our website by children under the age of 13 must be under the supervision of the parent or guardian of this child. No information must be transmitted to our website by anyone under the age of 13 without the consent of their parent or guardian. Once we discover that a user under the age of 13 has communicated online personal data, we will take appropriate steps to delete such data from our databases and not use this data for any reason (except where required, to protect the child or others in accordance with the law). We recommend that minors over the age of 13 seek parental leave before disclosing any personal information to a third party via the Internet.

AMENDMENTS TO THIS PRIVACY POLICY

We may periodically modify this Privacy Policy. The processing of the data we collect is subject to the Privacy Policy in force at the time of use of this data. In the event that we modify the way we use Personal Data, we will notify you by posting a notice on our website. You can find out if modifications have been made to this Privacy Policy by noting the date of the last update. You are bound by any modifications to the Privacy Policy if you use the website after the initial publication of such modifications.

Our business, operating under the distinctive title "BOHBO Designer Second Hand", is based in Athens, Attiki (99 Mavromichali Street, Postcode 11472, Athens, Greece, Tax Registration Number 139940854, DOY D’ Athens, telephone no. +302103389202), it has been active since 2007, maintaining a store which provides second hand designer clothing, shoes and accessories (all in excellent condition) in the centre of Athens; it is currently expanding through this e-store to the exhibition and sale of its products through the internet. Our new e-shop purports to enable all internet users to be directly informed of our products and to buy them through our e-shop, by placing an order with our online system, provided the selected product(s) remains available. 

Before you proceed with any transaction with us through the present website (www.bohbo.eu) please make sure that you agree with the following terms and conditions which cover all our transactions; each and every transaction with us implies full acceptance, on your part, of these terms and conditions.

1. TERMS AND CONDITIONS

The present terms and conditions comply fully with the European and the Greek legal framework currently in force, our business reserving the right to amend unilaterally or to update the terms and conditions of our online transactions. Our business undertakes to notify the users for any amendment or other change through the website of the present electronic shop. Amendments do not cover the orders which have already been placed.

2. INFORMATION AND PRODUCTS

Our business guarantees the completeness and the validity of the contents of our e-shop, with regard to the substantive characteristics of each offered product, with the reservation of any accidental technical or typographical errors which have escaped our attention or have come about unwillingly or due to interruptions of our service by reasons beyond our control.

3. LIMITATION OF LIABILITY

Our business and the e-shop bear no responsibility for any technical problems which may be faced by users when they try to access our website, and for as long as they remain there, and which relate to their own operation or to the compatibility of their own systems with the usage of our website. Furthermore, our business accepts no responsibility for the acts or omissions of third parties, especially for the interference of third parties with our products and/or with the information provided in the website.

4. OBLIGATIONS OF USERS

The users of our website are hereby forbidden to use it and the e-shop for sharing, posting, or publishing via email or transmitting by any other means any content which is illegal, unfair, spiteful, interfering with the private life of any other person, or which is discriminatory on any ground such as sex, race and nationality, or which infringes any patent, trademark, commercial secret, intellectual property or other property rights of third parties, or which contains software viruses or any other codes, files or programs that have been created with a view to interrupting, causing harm, destroying or impeding the operation of any software or computer hardware and which, willingly or not, breaches the relevant Greek and EU law currently in force and which is capable of harassing third parties in any way and/or is being used for the collection or storage of the personal data of the users.   

5. PROTECTION OF PERSONAL DATA

For the completion of any transaction through our e-shop (www.bohbo.eu) and for ordering the products of our business you will be asked to share with us some personal information. When you are placing an order, you will be asked to provide your full name and surname, the address where you desire our products to be shipped, your phone number and your email.

This data will be handled by our business in full compliance with Article 7A, par. 1(b) of Law 2472/1997 with a view to carrying out the order you placed and shall not be revealed, publicized or sold to third parties in any way, unless the procedure provided by law for the removal of confidentiality is followed (Law 2225/1994) or obligations arise which derive from the implementation of Directive 24/2006.  

The details of credit cards are entered exclusively in the safe environment of Paypal and our business keeps no record of such details.

6. OUR PRODUCTS WHICH ARE AVAILABLE FOR SALE AND THE LIMITATION OF LIABILITY FOR THEIR AVAILABILITY

You can be informed of the characteristics of our products which are up for sale by following the search instructions that are outlined on our website, by clicking on the name of the relevant product.

Each product is specific and unique, just as it is pictured and described, and is not available in another size or color. Our business makes sure that you will be notified directly and in time as to the availability of our products. However, due to the fact that in parallel with this e-shop we also operate our store, there is a chance that you may order a product which has already been sold in our store before we get the chance to update our e-shop as to the unavailability of the said product. In this case, you will receive an email notification of such unavailability within one (1) day after your order. In case you have already paid for the product through Paypal, we will provide a refund within five (5) working days after your order. If your order has been placed on a Saturday or a Sunday you will receive notice of any unavailability on Monday, unless your order is placed during a holiday period, in which case you will be notified within the next working day. Even in case our business is unable – due to unforeseeable circumstances- to notify you of the unavailability of a product within the above mentioned deadline, it commits to giving you your money back within the deadline of five (5) working days after your order.

Our business does not provide any kind of guarantee as to the availability of the products which appear on our website, but it does guarantee that you will be notified of any such unavailability within the aforementioned deadlines. The transaction will only be deemed completed after receipt of a written electronic confirmation. In case that the carrying out of an order is rendered impossible –including for the reason of unavailability of the product- we maintain the right to withdraw and not to fulfill our obligation and, where the price has already been paid, you shall receive a refund within five (5) working days.

7.  ORDERING AND THE PROCEDURE TOWARDS ITS COMPLETION

The completion of an order through an electronic shop constitutes a contract for distance selling which is regulated by the legal framework set by Law 2252/1994, as amended.

In order to place a valid order through our e-shop you must have the capacity to perform legal acts within the terms of the Greek Civil Code (that is, you must be at least 18 years old and you must not be subjected to judicial interdiction as to your capacity to enter into a sales contract).

The procedure towards the completion of an order through our e-shop begins by filling in the special form with the necessary details for the conclusion of the sales contract.

Through our website you will be informed by our business about the completion of the order and the substantive characteristics of the product, its price, its quantity (which cannot be more than one, given that each of our pieces is unique), the shipping costs, the manner of payment and delivery.

After submitting the order form you, you will receive in your email a copy of your order.

8. PAYMENT METHODS

• Payment upon delivery (only valid for orders which are to be delivered in Greece). In order for this payment method to be available, the total value of an order must not exceed 2,000 Euros.

NOTICE:

In case you choose cash on delivery as the form of payment, we will send you your order right away. Please note that we can delay the delivery for a maximum period of 5-7 working days, counted from the day we have received your order.  If you want to receive your order at a later time, you need to select another form of payment which secures the prepayment of your order. Otherwise we reserve the right to cancel the order without further notice.

The price stipulated under each product is final (second-hand goods are excluded from VAT).

Our website (www.bohbo.eu) reserves the right to readjust its prices without informing its customers. Such a readjustment will not concern the orders which have already been placed.

Orders which are to be delivered outside of Greece (either within or outside the EU) could be subjected to additional charges due to differences in exchange rates, customs clearance etc. the cost of which our customers undertake to cover, our business bearing no responsibility.

If you have refused to collect a product you ordered and the product is returned to our business with the sign ‘NOT INTERESTED’.

9. SHIPPING

9.1. Greece

Delivery of our products is conducted in the Prefecture of Attica and the rest of Greece through the company Geniki Taxydromiki Courier within 1 to 3 working days after your order.

For deliveries in Greece, shipping is free.

9.2. Cyprus

Deliveries in Cyprus are conducted through the company Geniki Taxydromiki Courier within 7 (seven) working days after your order.

For deliveries in Cyprus, the additional charges for transportation costs are outlined in the table below (24% VAT included):

0-4,99 kg: 12,00 €
5-10 kg: 20,00 €

9.3. Other Countries

Deliveries in other countries are conducted through the company FedEx within 2 to 6 working days after your order.

Calculation of transportation costs will occur in your basket after you have typed the area and the address where you wish the product(s) to be shipped.

If a consumer wishes a product to be shipped in a country which is not included in the above list, he/she may contact us at info@bohbo.eu, we will send him/her an email with the shipping rates and -if the consumer agrees- we will proceed with the order which will be agreed upon via electronic communication between the consumer and our business.

In case of delay in one of our deliveries for reasons which concern the regular procedures of the customs authorities of a country or for any other reason which does not concern our business, our business bears no responsibility.

Any consumer who wishes to do so may, during the placing of an order, declare that he/she will collect the ordered product from our store, but payment will take place through Paypal.

10. RIGHTS OF CONSUMERS

Even though the description of our products is detailed and you can form a full picture of the product, you may, upon delivery, realize that it does not correspond to what you desired or that the size is wrong. In such cases, www.bohbo.eu allows you to return the product within fourteen (14) days after delivery, while our business will return your money to you within fourteen (14) days after we have received back the said product. Refunds of money which have been transferred to us through Paypal or Credit/Debit Card will also take place through Paypal or Credit/Debit Card, while money paid upon delivery of the goods will be deposited to the bank account the consumer has given to our business.

You have the right to withdraw from our sales contract, with no need to provide a cause, within fourteen (14) days after the delivery of the product and in that case we will return your money to you within fourteen (14) days after our business has received back the said product.

If a product is returned for any reason, such a return will only be accepted if the consumer has paid all the necessary transportation costs for the return of the product.

A declaration of the intention to return a product must be communicated in writing or electronically at info@bohbo.eu and our business is under an obligation to send an electronic confirmation of receipt of such a declaration when it receives it. The consumer must indicate in his/her declaration of the intention to return a product the manner in which the product will be returned to our business.

It is hereby made clear that the returned product must be in the same condition it was when it was shipped by our business. More specifically, returned products must not have been used, ironed, washed or have been subjected to any other cleaning process, while the tags which come with them, as well as the cases, boxes or any other packaging in which they have been put, will have to be in place, just like when you received them. Failure on your part to satisfy this obligation gives our business the right not to return your money.

In all of the above scenarios, the expenses of delivery/shipping (couriers and banking fees) are undertaken by the consumer who will also be responsible for any loss, damage or deterioration of returned products until they have been received by our business.

If you wish to cancel your order after completion of the electronic order and before the shipment of the product(s) please contact us at info@bohbo.eu or call as at +30 2103389202 (during working hours) and your order will be cancelled immediately.

In case you ask for an alteration in an order which has already been executed (that is, you have already received the email informing you of the shipment number of your order) you will be charged twice the shipment fees of your order. The same applies if your order is returned to our business due to your failure to collect it and you ask for it to be shipped again.

The items bought in store and via "Pay in our Bohbo store" can't be returned.

11. VARIOUS

If for reasons of force majeure (e.g. bad weather condition, strikes etc.) it is not possible for us to deliver to you the products within the agreed timeframe you will be informed via email. Our business bears no responsibility for any situation which lies beyond our sphere of control but it will do its best to provide you with the best possible service.

Our business reserves the right to amend and renew the terms and conditions of our transactions. Our business also undertakes the obligation to update the present text with any amendment or addition to the terms and conditions.

The present terms and conditions are governed by Greek law and fall under the jurisdiction of the Courts of Athens.
